Transparency Law

Introduction

In this document, the following companies comply with the provisions regarding TRANSPARENCY, as stipulated by the Canary Islands Transparency Law 12/2014 and the Spanish Transparency Law 19/2013. The Canary Islands Law 12/2014 includes in article 3.1, letter b), companies or private entities that receive more than 60,000 euros annually in public aid as subjects covered within its scope; as does the basic state law (Law 19/2013), by establishing a set of informative obligations that are more limited than those contemplated in the Canary Islands law or other regional regulations. The Canary Islands Transparency Law indicates that “the commissioner is obliged to present an annual report to the Parliament of the Canary Islands on the application and compliance with the transparency obligations by the various public and private entities of the Autonomous Community, with the minimum content outlined in the law.” And in article 64, it is determined that private entities “must provide the Transparency and Access to Public Information Commissioner with the information requested and offer the necessary cooperation for the development of their functions. Specifically, they must keep updated and available detailed information on the degree of application of the law in their respective areas of competence.”

It is a body created by the Canary Islands Transparency Law, dedicated to the promotion, analysis, control, and protection of transparency and the right of access to public information within the Canary Islands. In exercising the functions attributed to it by Law 12/2014, of December 26, on transparency and access to public information, it must act with autonomy and full independence. The regulation of this body is outlined in Title IV of the aforementioned Law. The Transparency Commissioner is granted various powers, among which two main ones stand out: overseeing compliance with the obligation to publish the information listed in Title II of the Law by the bodies and entities subject to it (known as “active publicity”); and resolving the claims filed by citizens against the explicit or presumed decisions regarding requests for access to information from the entities and bodies included within the scope of application of the Canary Islands Transparency Law.
